SC hands Mayawati victory
The Supreme Court on Wednesday gave the go-ahead for the creation of a district carved out of Amethi Lok Sabha constituency represented by Rahul Gandhi and named after dalit icon Chhatrapati Shahuji Maharaj.
Setting aside the August 18 interim order of the Lucknow bench of the Allahabad high court, which stayed the UP government’s July 1 notification for the creation of a new district called Chhatrapati Shahuji Maharaj Nagar till March 31 next year, a top court bench comprising Justice R.V. Raveendran and Justice H.L. Gokhale described the high court order as an act of judicial impropriety.
The top court passed the order on the ground that an earlier petition challenging its decision was dismissed by the same high court on August 11.
The bench said, “Judicial propriety demanded that the high court should have considered the final judgment of August 11. It could not have taken a different stand.” A division bench of the high court comprising Justice Uma Nath Singh and Justice Satish Chandra had dismissed a petition on August 11 challenging the creation of the new district.
