The Supreme Court on Monday declined to stay the Madras high court order restraining sacked Tamil Nadu Bar Council chairman R.K. Chandramohan from functioning even as a member of the body after his re-election recently.
Chandramohan was sacked by the high court in 2010 on the charges of trying to “fix” a case on behalf of former telecom minister A. Raja, who wanted to contact a judge, who was seized of a bail matter of the ex-minister’s relatives.
Justice Reghupathy, who has since retired, had made announcement in the open court about the alleged attempt of Chandramohan to make him speak to Raja.
While Chandermohan’s appeal against the sack order was pending before the apex court, he contested the election to the Bar Council of Tamil Nadu and was elected as its member, and is reportedly aspiring to contest for the chairmanship’s post again.
E.G. Rajendran, who had filed the main complaint against him, challenged this in the HC in a fresh petition and the HC by an order of April 9 restrained him from functions as the member of the body in view of the complaint against him not yet decided by the Bar Council of India (BCI).
Though a bench of Justices D.K. Jain and H.L. Dattu admitted Chandramohan’s latest appeal, the judges refused to stay the HC order considering the fact that the matter is still pending before the BCI.
The top court issued notices to the BCI, Tamil Nadu Bar Council and Tamil Nadu Advocates Association.
His original appeal against the sack order is also pending before the same bench.
