Bengaluru, Feb. 14: The Karnataka Chief Minister, Mr B.S. Yeddyurappa, on Monday termed as a historic judgment, the decision of the High Court to uphold Speaker’s order, disqualifying five independent MLAs from Assembly membership.
“It is a historic judgement that will go a long way in strengthening the roots of democracy and restricting legislators from anti-party activities,” he said.
“It is a big lesson to all the MLAs and MPs and all Ayarams and Gayarams in this state and other states,” he said.
“I welcome the decision of the High Court. It is a victory for the legislative process,” he said, hailing the dismissal of petitions filed by independent MLAs challenging their disqualification.
Earlier in the day, the full bench of the high court comprising three judges, headed by Justice Mohan Shantanagoudar dismissed the petitions of the five independent MLAs and fully justified the order of the Speaker ruling that it is as per the constitutional mandate.
“We are of the view that the order passed by the Speaker challenged by five MLAs is not in violation of constitutional mandate nor is there any infirmity based on malafides or perversity,” court held. The court in its order running up to ‘191’ pages has mainly answered the three vital questions, including contentions and arguments raised by the parties on both sides, while passing the orders.
