A city court on Wednesday said that no FIR can be ordered on a complaint against Delhi transport minister, transport commissioner and others for allegedly illegally allowing the bus, in which the December 16 gangrape took place, to ply.
Special judge Narottam Kaushal disposed of the complaint seeking direction to the Delhi police for registration of a case against them holding that the issues raised in it are similar to those in the FIR which was registered against the bus owner Dinesh Yadav early this year.
The court passed the order on the complaint filed by RTI activist Vivek Garg against city transport minister and others alleging that the December 16 gangrape incident had occurred due to their “corrupt” activities and glaring irregularities in transport department.
The court said, “No fresh FIR can be ordered to be registered on the same facts and circumstances. The present complaint is, therefore, disposed of with no directions.”
The court further added, “Complainant will be within his right to join investigation and make available to the IO any information which may be in his possession/ knowledge. Needless to say that the investigating officer shall give due weightage to any such material and incorporate the same in the supplementary chargesheet after thorough investigation.”
While passing the order, the court considered the status report filed by the police on the complaint and also the contentions made by Garg.
The court noted that the police, in its report, had said that the driving licence of Dinesh Yadav was found to be issued on the basis of forged ration card and he and the motor vehicle inspector responsible for the same have been arrested and chargesheeted.
The probe agency had also said that the registration of the bus was not found to be irregular and the issue regarding fitness certificate of vehicle is under investigation.
