RTI activists demand info on Kasab death

RTI activists have approached the appellant court after the registrar of the city civil and sessions court refused to share information about the issuance of death warrant against convict Ajmal Aamir Kasab under the Right to Information Act (RTI).
The activists have prayed to the court asking it to direct the public information officer (PIO) to share the information. Santosh Daundkar had filed the RTI in November 2012, asking for the case papers, as well as the death warrant of the terror suspect. However, the RTI plea was rejected by the PIO.
Advocate Abha Singh, who was appearing on behalf of the RTI activist, maintained, “We want the entire file of the case that was registered against deceased Kasab, right from January 2009. We feel that Kasab was denied natural justice. We want to find out why the police, the judiciary and the government were so tight-lipped, when they were to execute the death sentence of Kasab. What was the need to maintain so much secrecy while executing his punishment, when the case was conducted in an open court?”
She further added, “The worst part is that the authorities did not follow the law as they failed to provide the death warrant to the defense counsel of Kasab. The international community will use this as an example against India, whenever we need the extradition of any accused.”
S.P. Patange, the registrar of the sessions court on December 2011 had maintained that the registrars’ office would not be able to provide with judicial information under the provision of Maharashtra District Courts Right to information rules, 2009 as the activist was not part of the 26/11 case.
