A consumer forum has ordered the Seth builders to pay a compensation of `6,32,000 to the complainant with an interest rate of 9 per cent per annum from 1999 for failing to handover the possession of a flat within the promised period.
In 1997, Pradnya Wakpainjan had booked a flat in Vasant Leela apartments, one of the projects started by Seth builders at Ghodbunder Road, Thane.
The total cost of the booked flat was `8,03,000. To sign the agreement, Ms Wakpainjan paid a token amount of `6,32,000 to the builder.
The builder had promised her to hand over the possession by October 1998, however failed to do so.
There was a delay of almost five months after which Ms Wakpainjan decided to cancel the deal.
She sent a legal notice to the builder stating that she wanted to cancel the deal because of the delay.
The builder, however, refused to comply and sent a legal notice to the complainant stating that she had failed to pay the rest of the amount and demanded the money at the earliest, forcing
the complainant to approach the state consumer forum. Appearing for the builder, advocate S.B. Prabhavalkar, said, “The builder had filed an agreement in the forum, assuring the complainant that the invested money would be returned to her on the condition that she terminates the agreement. But she didn’t accept our deal and directly approached the forum.”
Apart from the compensation, the forum after going through all the details in the case, ordered the builder to pay an additional `25,000 to the complainant for the mental agony she faced.

Elite juhu club staffer abducted, rescued in 1 hour

An employee of an elite club in Juhu, who was kidnapped on Tuesday afternoon, was rescued around an hour after his abduction.
According to police sources, Anjaam Ali, who works with the Millenium Club in Juhu, was abducted from the club’s parking area at around 3 pm on Tuesday. Filmmaker Ashoke Pandit, who was exiting the club at the time, saw Ali being brutally assaulted and tried to intervene. Ali was forced into a Mahindra Scorpio. Mr Pandit, however, noted the car’s registration number, and called the Juhu police to inform it about the abduction. “Inquiries at the club revealed that the men had come asking for Ali and had taken him out to the parking lot,” said an officer with the Juhu police.
Further inquiries revealed that the car was registered to an address in BDD Chawl, Worli. At around 4.30 pm, the Scorpio was intercepted and Ali was found in the backseat. The six abductors were taken into custody and Ali was sent to Nair Hospital for treatment.
