A city court has directed initiation of perjury proceedings against a retired Delhi police official for giving false evidence by fabricating the dying declaration of a dowry death case victim.
The court’s order came after retired sub-inspector Ram Saran failed to explain his act of deposing falsely before it.
“Vide separate proceedings, a complaint is being sent to the additional chief metropolitan magistrate, Rohini, with a request to initiate proceedings against retired S-I Ram Saran for fabrication of evidence and deposing falsely in the court,” additional sessions judge Kamini Lau said.
The court said that despite being the investigating officer of the case, Saran falsely deposed that the accused and his relatives were not present in the hospital when the victim was brought there.
The judge said the medical records showed that the victim was brought to the hospital by her husband, an accused in the case, and his presence was later established by the testimony of a doctor who treated the woman.
The court said that Saran had also deposed falsely on the aspect that the victim was declared fit for giving a statement whereas the doctor had refused to give him a fitness certificate and had told him that her condition was deteriorating.
“It was despite the same that S-I Saran proceeded to take thumb impression of Rachna (victim) on her alleged statement under circumstances which are suspicious,” the court said.
The court, however, convicted Rachna’s husband Manoj Kumar for harassing his wife, which led to her death and released him for the period already undergone in jail with a fine of `1 lakh stipulating that, if recovered, `50,000 should be given to the parents of the deceased woman.
