SC refuses to vacate stay, no early TN polls
The hopes of the DMK-led coalition to hold the elections to the revived Tamil Nadu Legislative Council before April 13 Assembly polls were dashed with the Supreme Court on Thursday refusing to vacate its interim stay at least till next hearing on April 4.
Though a bench of Justices J.M. Panchal and H.L. Gokhale admitted Tamil Nadu government’s petition for making it a party in the pending case on the issue of delimitation of LC constituencies, the court rejected state’s plea for vacating the stay order.
As per the stay granted earlier, the top court had said that no elections could be held till July 11 when the case would be taken up for further hearing.
But the top court agreed on Thursday to advance the date of hearing to April 4 after the request of Tamil Nadu government counsel.
The state government had written to the election commission to initiate process for holding the elections to the LC in the first week of March.
Even if the apex court accepts the Tamil Nadu government plea on April 4 for lifting of the stay, the polls to the LC could not be held before Assembly elections scheduled for April 13.
