HC restraint on magazine for publishing Divya story
Chennai: The Madras HC on Monday restrained Nakkheeran Gopal from publishing the photograph, caricature or any article touching the personal life of Divya, wife of the deceased Dalit youth Ilavarasan, containing false and defamatory allegations against her in his weekly magazine Nakkheeran.
Passing interim orders on a suit from Divya, Justice R. Sudhakar said Divya came to know that Nakkheeran was going to publish Ilavarasan story, in which they were publishing her story line with false allegations and it was defamatory in nature.
Five publications were already effected. If it was published, her future reputation will be spoiled. Her counsel K. Balu submitted that if it was allowed to be published, it would create communal disharmony.
“Considering all the facts and documents, prima facie, this court is satisfied with the facts and particulars of the case to grant interim injunction. Accordingly, interim injunction is granted until further orders,” the judge added.
The judge also ordered notice to Nakkheeran Gopal. In her suit, Divya demanded Rs 25 lakh as damages.
