ED notices to 4 companies over Fema violations
The Enforcement Directorate (ED) on Wednesday issued show-cause notices to four firms for alleged foreign exchange violations of `3,805 crores in connection with its probe into the 2G spectrum scam case.
Sources said notices have been issued against Loop Telecom Limited, New Delhi, for `549 crore, Ms Loop Mobile (India) Limited, Mumbai, for `26 crore, Ms DB Realty Limited, Mumbai, for `2,831 crore and Ms ETA star property developers private limited, Chennai, for `399.50 crore for alleged contravention under the Foreign Exchange Management Act (Fema).
Sources said notices sent to these companies have cited various charges of violation of RBI guidelines in place for receipt of FDI and routing of funds to and from foreign shores. The notices can be challenged by the firms in the appellate authority of the Fema which acts as a quasi-judicial court.
The ED has been probing financial transactions and role of these firms case for sometime and the agency issued notices after going through all the evidence and information received from these respective firms, sources said.
ED sources added, “As per Act, penalty under section 13 of the Fema, may be up to three times the sum involved in such contravention”.
