ED has option of arresting Jagan: Experts
Legal experts feel that the Enforcement Directorate has the option of arresting Kadapa MP Y.S. Jagan Mohan Reddy under the Prevention of Money Laundering Act (PMLA).
An ED team from Delhi arrived in the state on Tuesday to prepare the grounds for a speedy probe in the money routing case of Mr Jagan Mohan Reddy. They will be filing a petition in the CBI court seeking permission to question the Kadapa MP in jail.
It has already sought the court’s permission to question the other accused. Senior high court advocate Vishnuvardhan Reddy said, “The CBI case does not cover PMLA. The chargesheets filed by the CBI pertain to the Indian Penal Code and Prevention of Corruption Act cases. The Enforcement Directorate has registered a separate enforcement case information report under the jurisdiction of the local esignated Economic Offences Wing court at Nampally.
Briefing the law sections Reddy said, "Under Section 19 of PMLA, the ED can arrest the accused. Under Section 4, the punishment shall be not less than three years and up to seven years and can attract a fine of up to Rs5 lakh."
