Court to decide Amar Singh’s bail plea on Tuesday

A Delhi court will tomorrow decide the interim bail plea of Rajya Sabha MP Amar Singh, who is currently in lodged in Tihar Jail following his arrest in the 2008 cash-for-vote case.

Special judge Sangita Dhingra Sehgal on Monday reserved her order after hearing senior advocate Ram Jethmalani, who argued the case of the 55-year-old former Samajwadi Party general secretary.

Singh "is not going to die but is really sick," Jethamalani pleaded while seeking his bail.

"Put up (the application) for order on Tuesday," the court directed as Jethmalani and public prosecutor Rajeev Mohan concluded their arguments.

The Tihar Jail authorities earlier submitted to the court the medical report on Singh's health, saying the results of some of the tests were still awaited and that they would be available only by Tuesday.

Pressing for interim bail, Jethmalani said Singh has undergone kidney transplant and that he is also suffering from urinary tract infection now. These suggest that he is "a sick and infirm person," he submitted.

While hearing Jethmalani argument for bail to Singh, the judge at one point asked him, "What is so pressing as far as medical condition is concerned on Monday?"

Jethmalani responded saying Singh's health condition is not good and even on merits there is nothing against him.

"It is not my case that I (Amar Singh) am going to die now, but I am really sick. There is nothing against me even on merits," he said.

Arguing that there is no allegation against Singh thathe arranged or gave money to anybody in the alleged offence, Jethmalani said the case is about a sting operation carried out by a private TV news channel.

"The sting was for the purpose of exposing corruption. Did I (Singh) give money to these BJP MPs? What has Amar Singh done in this? I am unable to find what I have done?," said Jethmalani, maintaining that even the charge sheet does not say that his client gave the money.

He also referred to senior BJP leader L K Advani's statement in Parliament, hailing as "whistle-blowers" the two former party MPs who have been also been arrested in the case.

He said former BJP MPs Faggan Singh Kulaste and Mahabir Singh Bhagora, besides sitting BJP MP Ashok Argal have not done "anything wrong" by waving money on the floor of the Parliament during the confidence motion.

The Delhi Police strongly opposed Singh's interim bail plea saying they have circumstantial evidence against him.

During the last hearing, the Tihar jail authorities had refuted Singh's contention that he was being kept in a general ward and having to share common toilets with others, rendering himself more vulnerable to infection after a kidney transplant.

The prison authorities, during the last hearing, had told the court that Singh has been kept in a separate cell under hygienic conditions in the prison.
