Aarushi’s parents move Allahabad HC
Aarushi Talwar’s dentist parents Rajesh Talwar and Nupur Talwar have on Monday moved the Allahabad high court challenging the order of special CBI court in Ghaziabad, making them accused in the Aarushi-Hemraj double murder case. The case is likely to come up for hearing on Wednesday, February 23.
Dr Talwars’ lawyer, Rebecca John, on Monday has filed an application in the Allahabad high court challenging the order of the Ghaziabad special CBI court.
On February 9, Dr Rajesh Talwar and Dr Nupur Talwar were charged by the Special CBI court with various sections of the Indian Penal Code (IPC), including 302 (murder), 201 (destruction of evidence) and 34 (acts done by several persons in furtherance of common intention) in the sensational Aarushi-Hemraj double murder case.
Ms John, talking to this newspaper, said, “We have filed a criminal revision petition in the Allahabad high court against the special CBI Court’s order summoning the dentist couple for February 28 in the double murder case.”
Ms John, however, refused to divulge any other information and added, “I would not comment on the merits of the case as the case is subjudice.” The case is likely to come up for hearing on Wednesday, February 23.
The court in Ghaziabad took note of the evidence produced against the Talwars by the investigating agency and made them as accused in the murder case.
The CBI, which was entrusted with the investigation in the case following an uproar over the alleged shoddy probe by the UP police, had on December 28 submitted its closure report pointing fingers at the parents though it maintained there was no conclusive evidence. The court, however, decided to proceed with the trial against the couple observing that there was “enough evidence###################”. The CBI court also added Dr Nupur Talwar as a co-accused. The court had also rejected Dr Rajesh Talwar’s petition against the CBI closure report. On May 17, 2008, Aarushi Talwar, a 14-year-old school student, was allegedly found dead.
