HC cancels Vijay Sai Reddy’s bail
The AP High Court on Friday set aside a bail order granted by the special CBI court to V. Vijay Sai Reddy, auditor and co-accused in the alleged disproportionate assets case of YSR Congress president Y.S. Jagan Mohan Reddy.
While setting aside the order, Justice K.C. Bhanu sent back the matter to the special court, directing it to restore the bail plea and pass appropriate orders after hearing both the parties.
The judge permitted Mr Vijay Sai Reddy to surrender before the special court on Monday and asked the special court to take up hearing on the bail plea soon after his surrender on the day.
The special court had granted bail to the auditor on April 13, on the ground that the rest of the accused had not been arrested.
While granting the bail, the CBI court had refuted the CBI’s contention that the accused would cause hurdles to the probe.
It was observed that as other offenders were free, they too could attempt to impede the investigation.
Justice Bhanu faulted the CBI Court in granting bail to Mr Vijay Sai Reddy on the ground that the rest of the accused in the case had not been arrested.
Terming the order of the CBI court as unreasonable, Justice Bhanu obser-ved, “The order will not be valid without citing reasons for granting bail by duly following the well-established principles laid down by the apex court and also under the Cr PC .”
The judge pointed out that the CBI court did not take into consideration a memo informing it that the investigation in the case had not yet been completed and the response to Letters of Rogatory, sent to six countries, was yet to be received.
