Frivolous plea: Petitioner fined
A division bench of the AP High Court comprising acting Chief Justice V. Eswaraiah and Justice Vilas V. Afzulpurkar of the AP High Court on Thursday imposed a fine of Rs 50,000 on a petitioner for wasting the court’s time by filing a frivolous plea in the name of public interest.
Bellapu Nageswara Rao, president of Mutyalamma Mogaltur Mandalam Cooperative Building Society filed a plea challenging the new liquor policy announced by the state government for 2012-13. The petitioner contended that not providing reservation for Backward Classes is contrary to law and urged the court to direct the government to follow the rule of reservation in allotting shops.
Mr A. Sudarshan Reddy, advocate-general, argued that reservation was only an enabling provision; and in any event, doing business in liquor was not a right that can be executed. Agreeing with the contention of the AG, the bench found the petition to be misconceived and dismissed it. It directed the petitioner to deposit the fine with AP Legal Services Authority within two weeks.
Jagan’s plea to use media put off
Justice K.C. Bhanu on Thursday adjourned the hearing of a plea by Y.S. Jagan Mohan Reddy seeking a direction to the Chanchalguda jail authorities to allow him communicate to people from jail through electronic and print media. The petition will be heard next week. Mr S. Sriram, counsel arguing on behalf of Mr Jagan, contended his client had a right to speak to the citizens and a jail manual prepared in colonial times could not be implemented now. Counsel for government sought time to file his counter affidavit.
