DGP case: HC begins hearing
A Division Bench comprising Justice Goda Raghuram and Justice N. Ravi Shankar of the AP High Court on Tuesday commenced its hearing on petitions by the state government and the DGP Dinesh Reddy. The petitions were filed challenging the order of the Central Administrative Tribunal, which had declared Mr Reddy's appointment as Head of the Police Force, unsustainable under law.
A-G A. Sudarshan Reddy, defending the government’s decision to appoint Mr Reddy as the HOPF, said the CAT finding with regard to non-implementation of the apex court’s direction in Prakash Singh case while making the appointment, was incorrect. He contended that the Prakash Singh case would not be applicable as the Centre amended the IPS Pay Rules based on the findings of the Apex Court in that case.
Mr Sudarshan Reddy said that two earlier orders of the CAT which held that the appointments of R.R. Girish Kumar and K. Aravind Rao as the HOPF were illegal, were stayed by the Supreme Court and another by the HC. He urged the co-urt to stay the CAT order. The arguments will continue on Wednesday.
Retrenchment by bank stayed
Justice P.V. Sanjay Kumar of the AP High Court on Tuesday stayed an order of the Vasavi Cooperative Bank to retrench 28 of its employees who had approached the court. The judge directed the bank to continue the petitioners in service, without resorting to retrenchment on the basis of a resolution passed by the committee of the bank, pending further orders. Senior counsel S. Ramachandra Rao, appearing for the petitioners, argued that the person-in-charge of the committee had no legal sanction to continue in office beyond six years, as it was prohibited under the AP Cooperative Societies Act. The judge granted 10 day’s time to the bank to file its counter affidavit.
‘No’ to stay on HCA elections
Justice Bhavani Prasad of the AP High Court on Tuesday was not inclined to stay the elections of the Hyderabad Cricket Association. While dealing with a plea by Narender Goud, a member of the association, the judge made it clear that the process of electing the president of the association will go on, but it will be subject to further orders in the plea. The petitioner said that he was also in the fray for the post, but his candidature was dropped. He said that Vinod Kumar, who is set to become president, has not served as an executive member, as required under the by-law.
Notice issued to VUDA MD
Justice G. Chandraiah on Tuesday issued notice to the vice-chairman and managing director of the Visakhapatnam Urban Development Authority in a contempt case. The judge was dealing with a contempt case filed by one M. Salamma of Madhuravada in Visakhapatnam, stating that the authorities failed to regularise her land despite a specific direction of the court to consider her case within two months
