Court’s order confuses APIIC
The High Court interim order allowing registration of plots in the controversial Emaar integrated township project is causing some confusion about just how it should be implemented. On Tuesday, the court directed that the plots could be registered with certain conditions, which included depositing `15,000 per square yard of the plot with the Andhra Pradesh Industrial Infrastru-cture Corporation (APIIC).
Sources told this newspaper that APIIC is confused about how to implement the interim order. “The registration arises only after the plot owners complete the construction of villas,” sources said. The agreement of sale between the plot owners and Emaar Hills Township Limited (EHTPL), a joint venture of Emaar and APIIC, clearly mentioned that the former cannot leave the plot open and should construct villas as per the specifications of the EHTPL. The plot owners shall have to pick one among the four models.
The High Court’s interim order, on the other hand, gives the nod for registration of sale deeds. “If sale deeds are executed, a semblance of clarity will exist,” the court said, and even pointed out that the agencies that enriched themselves by receiving almost the entire consideration, are likely to take advantage of the situation unless the sale deeds are executed.
Sources said APIIC is afraid of the plot owners taking advantage of the interim order and pushing EHTPL for registration of open plots also. “We have to seek legal opinion on whether the plea for registration can be entertained only after construction of the villa,” sources said adding that the option of challenging the interim order before a division bench was also on the cards.
