CM to decide on prosecution

Taking special CBI judge O.P. Saini’s comments in the 2G spectrum case as a basis for its reccomendation in the Emaar scam, sources said, “The judge’s comment that a decision taken by a public servant does not become criminal for the simple reason that it has caused loss to public exchequer, is crucial.”

The law department had left it to Chief Minister N. Kiran Kumar Reddy to take a decision either granting prosecution or rejecting it.

Without going into the merits of the case, the law officials were said to have noted that the competent authority has powers to approve or reject prosecution.
