Youth gets 10 years’ jail for rape, fined
A youth, who had repeatedly raped a 20-year-old girl here on the false promise of marrying her, has been sentenced to jail for 10 years by a city court which relied on the DNA report of the victim’s child.
The court also relied on the testimony of the girl and other evidence produced before it while convicting 22-year-old Lalit Chauhan and imposed a fine of `45,000 on him.
It said that the prosecution has established that Chauhan had repeatedly raped the girl from December 2011 to March 2012 on the promise of marrying her but after she became pregnant, he refused to tie the knot with her.
“Admittedly, the fact regarding of having repeated sexual intercourse with the prosecutrix has not been disputed by the accused (Chauhan) nor the fact regarding the pregnancy of the prosecutrix consequent upon the act of having repeated sexual intercourse with the prosecutrix has been disputed by the accused.
“Nor the fact regarding the baby girl born to prosecutrix on September 4, 2012 was fathered by accused Lalit Chauhan has been disputed by the accused,” additional sessions judge M.C. Gupta said, adding the victim had “delivered a baby whose DNA profiling matched with Lalit Chauhan as a biological father.”
The court convicted Chauhan, a resident of Vishwas Nagar here, for the offences punishable under the IPC, including Section 376 (rape), and under provisions of the Information Technology Act.
The girl had lodged a complaint saying Chauhan mixed some stupefying substance in her drink after which she fell unconscious. Chauhan first took her nude photographs and then raped her, the police said.
