DERC asked to hold tariff rule
The city government on Friday told the Delhi high court that it has decided to withdraw its earlier direction to Delhi Electricity Regulatory Commission (DERC) to put on hold the decision on power tariff for 2010-2011.
Appearing for the NCT government, standing counsel Najmi Waziri told the division bench comprising Chief Justice of the Delhi high court Dipak Misra and Justice Manmohan that the government would withdraw its May 2010 direction asking the Commission to put on hold its decision on tariff. The court, however, reserved its verdict on the issue whether the state government has the jurisdiction to pass any order to the Commission.Following an order of the court, Attorney General G.E. Vahanvati, appeared before the court and submitted that “under the Delhi Electricity Act, the state has no jurisdiction to pass such an order.” to the statutory function of the Commission”.
