Court clears man, 70, of rape charge
Keeping in view the contradictions in the case which rendered the complainant unreliable, a Delhi court has acquitted a man of charges of raping his daughter-in-law after noting that the complainant is not trustworthy and does not inspire confidence in any manner.
The complainant alleged that she was allegedly raped by her father-in-law in her house and registered an FIR against the accused, Jagdish Prasad Sabu at the Model Town police station.
“No sufficient explanation has been given as to why she did not raise any alarm or hue and cry at the time of the incident and from the same, the only conclusion which can be drawn is that no such incident took place,” additional sessions judge (ASJ) Vijender Kumar Goyal said while acquitting 70-year-old accused Sabu.
The court said that it seems improbable that if she was raped, then she did not disclose the incident to anyone in the family when it happened in the house.
“At the age of 70, there could not be any mental status of the accused (Sabu) to think of committing rape upon the complainant. So, in other sense, he was not capable of performing sexual intercourse in any manner,” the court said.
