‘Lot can still be done to make judiciary effective’

Even if retired judges and legal luminaries feel that India’s judiciary is one of the best in the world, but Delhi high court Justice S.N. Dhingra, who delivered various landmark judgements including that in the Parliament attack case, on Tuesday said, he did not agree with the claim and asserted that a lot was still to be done to make judiciary more effective.

Justice Dhingra, who demitted office on Tuesday after an eventful 22-year-long career as a judge of the lower court and the Delhi HC, said, “A lot is left to be done to make judiciary more effective so that justice is delivered to litigants in the shortest possible time and it should not take two lives to get the same.”
Not following the normal procedure to speak in English while demitting the office, Justice Dhingra spoke in Hindi during a full court reference, organised to bid him the farewell.
“I do not agree with the claim that our judicial system is the best in the world,” he said.
“Most of the lawyers were not happy with me and my approach as I only saw the litigants and not the faces of (big) lawyers and tried to deliver speedy justice to them. This was my strength,” he said.
Justice Dhingra had dealt with high-profile cases such as the Parliament Attack case, Nitish Katara murder, anti-Sikh riots, matters against terrorist outfits and related to Congress leaders H.K.L. Bhagat and Kalpnath Rai.
A day before his retirement, Justice Dhingra put forward the idea of audio and video recording of the HC and the trial courts proceedings to ensure the judiciary transparent and effective.
In this regard, he has referred his suggestion to the Chief Justice Dipak Misra to constitute a larger bench to delve into the issue.
