Govt is told US bound by pact on extradition
New Delhi, March 24: Gopal Subramanium, solicitor-general of India, is understood to have asked the Indian government to act tough and press hard for nothing less than the extradition of LeT operative David Coleman Headley, a conspirator in the 26/11 Mumbai attacks.
Mr Subramanium, whose advice was sought by the MHA, is understood to have argued that a plea bargain cannot be a substitute for an extradition treaty because the latter will always prevail over domestic laws. Further, the extradition treaty between the US and India is binding on the two countries. He is also understood to have said that all the papers relating to Headley’s extradition should be made available to US authorities.
