Sale deed issued by TN industrial body cancelled

The Madras high court has cancelled the sale deed executed by Tamil Nadu Industrial Investment Corportion (TIIC) in favour of one K.S. Palanisamy in respect of a property in Hosur.

A division bench comprising Justices Elipe Dharma Rao and M Venugopal held that Palanisamy had obtained the sale deed by playing fraud on the court and by misrepresenting the facts.

“To be eye-opener for the fraudulent clients like Palanisamy, who misrepresented the facts before the court to get favourable orders, a cost of `10,000 is imposed on him.

The cost should be remitted to the Tamil Nadu State Legal Services Authority within a week”, the bench added.

Allowing the appeal filed by Mohamed Fazal, against the order of a single judge, directing TIIC to execute sale deed in favour of Palanisamy, the bench directed TIIC to execute the sale deed in favour of Mohammed Fazal as per the sale confirmation certificate.
