Refund unused stamp papers: HC
The Madras high court has directed the Chennai district collector to refund within 10 days unused stamp papers worth Rs1.55 lakh to a woman.
Aminath Sharifa purchased stamp papers for Rs1.55 lakh for purchase of a property in 2004. The purchase was aborted and she approached the stamp vendor, who issued a certificate addressed to the tahsildar, Egomore-Nungambakkam and asked her to get a refund from the authorities.
On September 28, 2005, she surrendered the stamp papers before the collector and asked for a refund. However, no steps had been taken by the authorities.
The government advocate informed the court that the proceedings to refund Rs1,39,500 (after deducting 10 per cent) was underway and was at the stage of signing by the collector’s PA.
Justice M. Venugopal said that if any application for refund of the unused stamp papers had been made by a person within two years from the date of purchase, according to rules, 10 per cent deduction could be made and the balance refunded and directed the collector to issue a refund order within 10 days.
