HC orders arrest of ship
The Madras high court on Friday ordered the arrest of the ship MV Gati Pride, flying a Panamanian flag and now lying at Chennai port.
Justice K.B.K. Vasuki said petitioner Bino Wesley of Pammal near Chennai has made out a prima facie case to order the arrest of the ship belonging to Gati Coast to Coast, a division of Gati Limited. The petitioner sought a compensation of Rs 1 crore from the ship owners for the death of her husband and also sought the arrest of the vessel.
The petitioner said that her husband T.S. Frank Midson was appointed as the Third Officer in the ship under an agreement dated November 22, 2011, on a monthly salary of Rs 1 lakh.
On December 19, 2011, the ship was ordered to be arrested for non-payment of wages to its workmen. After the owners of the vessel settled the dues, the ship was ordered to be released in the last week of March this year.
However, during the arrest period, the ship was lying idle, was not properly maintained and was grossly deficient in safety arrangements. On March 24, her husband met with an accident while handling deck stores and was declared brought dead at a private hospital.
The petitioner contended that the ship owners were wholly responsible for the death of her husband due to negligence on their part.
