Girl gets compensation for parents’ death

The Motor Accidents Claims Tribunal (MACT) in Chennai has awarded Rs 91.78 lakh as compensation to a minor girl and her grandparents for the loss of her parents in an accident in 2009 in Chennai.

MACT presiding officer Gunavathi passed the order while allowing a petition from P. Kavinaya, her grandmother Valli and grandfather Kumar.

The petitioners claimed a compensation of Rs 15 lakh for the death of Priyanka alias Elizebeth Mary and Rs 1 crore for the death of Pratap Kumar.

Pratap Kumar was earning Rs 6.53 lakh a year. His wife Priyanka was working as a receptionist in a private firm.

Pratap Kumar came to Chennai on a 10-day vacation. On November 20, 2009, when he was going on a motorcycle with Priyanka, they hit a lorry at Indira Nagar and died on the spot.

The claimants contended that A. Shiek Mohamed of Thoraipakkam, the owner of the lorry and the ICICI Lombard General Insurance Company, the insurer were responsible for paying the compensation.

Awarding the compensation, the judge said the legal presumption was that the accident occurred because of rash and negligent driving by the driver of Sheik Mohamed’s tipper lorry.

The amount was reached at after considering the age of the deceased and their future prospects and applying the multiplier system.

Of the compensation, the child’s grandparents will get Rs 20.89 lakh each and the remaining `50 lakh should be kept in a fixed deposit in the name of Kavinaya till she becomes major.

The judge said of the compensation awarded, the parents will get Rs 20.89 lakh each and the remaining Rs 50 lakh should be kept in a fixed deposit in a nationalised bank in the name of Kavinaya till she becomes major.
