CBI to take over custodial death cases of labour leader

The Madras high court has transferred to CBI the four cases registered before and after the alleged custodial death of a labour leader following a labour dispute at a factory at Yanam, Puducherry.

Petitioner Matcha Durga, wife of deceased labour leader Murali Mohan, said he was working in the Regency Ceramic Factory at Yanam and was a labour leader. On January 27, 2012, during a workers’ agitation, a case was registered against him and others.

The same day, another case was registered based on a complaint by a sub-inspector alleging that he was assaulted.

The police arrested Murali Mohan and, according to police, her husband developed chest pain and died.

Following the custodial death, violence broke out and the factory was allegedly ransacked and factory president Chandrasekar was murdered, according to police.

Four more cases were also registered.Matcha Durga alleged that her husband was beaten by the police in the police station and no case was registered against the persons who killed her husband and sought to transfer all the cases to CBI from Yanam police.

The Puducherry government submitted that it had already transferred to CBI the cases relating to the custodial death of Murali Mohan and the murder of Chandrasekhar.

Justice T. Sudanthiram said the two cases related to the murder of Chandrasekhar and attack of the police station were consequences of the custodial death of Murali Mohan.

The other two cases related to the incidents before the alleged custodial death but this court feels that proper investigation should be carried out by the same CBI as it was to investigate the custodial death of Murali Mohan and the murder of Chandrasekhar.

Further, it would be convenient for CBI to investigate all these crimes that occurred the same day within a short span of time, the judge said.
