Order to conduct spl exam for engg students set aside

Expressing that the court must be circumspect in issuing directions which may be impossible to implement, like holding an examination, that too a university-level exam, within a week, a division bench headed by Chief Justice Vikramajit Sen on Friday struck down the order of a single judge directing the Visvesvaraya Technological University to announce a special supplementary exam for 30,000-odd engineering students within a week, who have to clear four subjects to get admission to the third semester.

On September 3, a single judge directed VTU to conduct a special exam and made it clear to students that they should pass all their pending subjects in the first two semesters, and only then will they be eligible for get admissions to the third semester.

The CJ, striking down the order, said, “We are unable to subscribe to the view of the learned single judge that a favourable jural dispensation is justified only for the academic year 2011-2012 and not across the board on similar lines.”

The court, referring to the single-judge order that held rules and regulations for both affiliated and autonomous engineering colleges should be the same, said this is not only an impossibility but cannot be seen as an expectation of the law.

PIL seeks action against killing of wild animals Following recent reports of over 100 wild animals being killed in the 17-km stretch of Bandipur Forest on the National Highway 212 by speeding vehicles, a PIL was filed by a city advocate G.R. Mohan, alleging that authorities are not showing any concern towards safety of animals in the forests.

The petition states that following a recent high court order directing the National Highways Authority of India and state government to ban the movement of vehicles between 8 pm and 6 am, trucks that used the Mysore route to go to Kerala have now started taking a shortcut through the Bandipur National Park.

“The forest department has failed to check illegal movement of vehicles,” PIL states. Ban on the movement of heavy duty trucks through Bandipur using the Mysore route to reach Kerala or Tamil Nadu is the permanent solution, it added.
