Bank staffers convicted of fraud
Two bank employees and three others have been sentenced to imprisonment for committing fraud and cheating under Prevention of Corruption Act by the city civil and sessions and special judge for CBI cases. In the first case, Mr N. Shivanna, the manager of Canara Bank’s Infantry Road branch, Mr Shivananjaiah, then an officer with the Corporate Consumer Finance branch, Infantry Road branch, Mr K.Vasudevan Namboothiri (died during trial) and Mr B.T. Satyanarayana were sentenced to imprisonment for a period of three years and fined Rs 4.50 lakh, collectively.
The CBI and ACB had filed a chargesheet in 2008 against Mr Shivanna and the three others under Section 120-B, 420, 468, 471 of IPC and Sec.13(2) r/w 13(1) (d) of the PC Act, 1988. The charges were that Mr Shivanna, while working at Canara Bank, Corporate Consumer Finance branch in Bengaluru, had entered into criminal conspiracy with the other accused in 2000-01 in the matter of sanction and disbursal of 95 loans on six different dates on inflated and forged salary/wage slips.
Further, the loan proceeds disbursed in the name of the borrowers by means of Demand Drafts were fraudulently encashed through a co-operative society. Thereby, the accused caused wrongful loss of Rs 117.79 lakh to Canara Bank and corresponding wrongful gain to themselves.
In the second case, City Civil and Sessions and Special Judge for CBI cases has sentenced Mr Rohidas Nayak, the then manager, Syndicate Bank, MRMC branch, Gulbarga, and his accomplice Mr K. Anand Rao to simple imprisonment for a period of five years and a fine of Rs 1.05 lakh, collectively.
The CBI and ACB had filed a chargesheet under Sections 120-B r/w 420, 409, 419, 465, 467, 468, 477-A of IPC and Sec.13(2) r/w 13(1) (d) of the Prevention of Corruption Act against Mr Nayak and the other accused.
Investigations revealed that Mr Rohidas Nayak, while working at Syndicate Bank, MRMC Branch, Gulbarga had entered into criminal conspiracy with other accused person in 1999-2001 and forged the NRE VCC receipt of other depositors without their knowledge. They had then obtained loan applications against the deposits and sanctioned loan to the other accused person who had impersonated the name of original depositors. Further, Mr Nayak also issued various cheques/DDs in the names of various firms in order to repay his own loans, thereby causing a loss of Rs. 46.35 lakh to the bank.
